Finwinhub is a financial education platform that provides valuable financial learning materials and related services through the website www.finwinhub.com (hereinafter referred to as “Website”).

  1. Overview of the Agreement

By using the Finwinhub product (“Service”), you agree to abide by these Terms and Conditions (collectively, “Terms” or “Agreement”). Additionally, the Privacy Terms and Subscription Terms are also included in this Agreement, meaning they are part of the Terms.

  1. Conditions of Participation

If you do not agree with any part of these Terms or are not eligible to use our Services, please do not access any part of the Service.

To use Finwinhub, you must be at least 16 years old and have the legal capacity to enter into an agreement. If you are under 18, you need parental permission. If you do not agree with these terms or are not eligible, please do not use our Services.

  1. Services We Provide

Finwinhub offers a range of financial learning materials, including articles, investment reading materials, quizzes, and digital investment simulations. We also provide an AI Chat feature for educational purposes. All these materials and services are collectively referred to as “Digital Content.” Please read carefully the disclaimers and warranties below related to this Digital Content.

You will have access to Digital Content and Finwinhub products after registering to use the Service, meaning you will need to register and pay for a trial or subscription plan (monthly, quarterly, annually, or any other option) depending on your choice at the time of purchase.

After purchasing and during the use of the Service, you may be offered additional paid features. Please read carefully the offers you receive from us.

  1. Digital Investment Simulation

When using our Service, you will have access to digital investment simulation. Please note that any transactions on this simulation do not involve real money, any “currency units” we use in the investment simulation are created for gamification purposes. This investment simulation will allow you to learn about and familiarize yourself with the stock market and online brokerage safely.

Finwinhub is not an investment or trading platform and does not provide any financial support or advice. Your investment decisions must be made at your own risk and entirely at your discretion. We are not responsible for any damage to your computer system, data loss, or monetary loss due to accessing or using the Service, or relying on any information or advice.

  1. AI Chat Advisor

When using our Service, you will also have access to the AI Chat Advisor (we call it “AI Chat”). The AI Chat is deployed for educational purposes and is not intended to provide investment advice.

How is your content managed when using AI Chat?

When using our AI Chat, you may provide your information (we call this “Input”), and we will generate responses based on your Input (these responses are called “Output”). You own your Input, and we transfer to you all rights permitted by law regarding the Output (collectively, Input and Output are “Content”). However, we may use that Content to improve our service, but you can choose not to allow this by contacting us.

Important note about the nature of AI Content

Due to the nature of machine learning, the Output may not be unique to users, and the Service may generate the same or similar output for Finwinhub or third parties. For example, you may provide input to a model such as “How many days are in January?” and receive output like “There are 31 days in January.” Other users may also ask similar questions and receive the same response. Responses requested and generated for other users are not considered your Content.

  1. Subscription Packages

What we can offer

Based on your choice at the time of purchase, we may offer you:

Trial packages are short-term offers providing limited access to basic features and content of the Service. They are typically designed for new users to test the platform before automatically transitioning to a subscription. You can cancel the trial package 24 hours before it ends. If you do not cancel, it will automatically convert to a subscription, and you will be automatically charged the full price for the subscription package without notice.

Subscription packages are agreements that grant you continuous access to the Service for a specified period of time (monthly, quarterly, or annually) after paying for the subscription service. Subscription plans automatically renew at the end of each period. You can cancel at any time before the current payment period’s 24-hour mark in your account settings.

Additional paid features are optional functions or services that we may offer you in addition to the trial or subscription package on a subscription or one-time purchase basis.

Important note! Some offers may renew at full price, not at a discounted rate. Therefore, please read carefully the terms of the trial or subscription package you choose when purchasing the Service.

Important note! About price changes. The prices and amount of Digital Content available through your trial or subscription may change over time by the region without the obligation of Finwinhub to clearly notify you (unless required by law). We will reasonably notify you of any price changes by posting new prices on or through the Website and/or by sending you a notification, or in any other prominent way. If you do not agree with the new price and do not want to pay, please cancel your subscription before it applies to you.

  1. Payment and Cancellation

We charge for our services through PayPal or other payment providers (Visa, Mastercard, and others). Your payment method will be charged according to your subscription plan. It is your responsibility to cancel your subscription in time.

Payment Methods

The payment method for the Service is processed by Finwinhub through PayPal or other payment providers.

Finwinhub charges the payment card you provide at the time of purchase (after you confirm by one-touch recognition, facial recognition, or entering your payment method details on the website, or otherwise accepting the subscription terms provided on the payment screen on our website).

You authorize us to store your payment method and automatically charge the applicable subscription fees to the payment card you provide for renewal.

Automatic Renewal Period

The automatic renewal period will be the same as your original subscription period unless otherwise notified to you on the Service. The renewal rate will not be higher than the rate for the immediate preceding subscription period, unless you are notified of the rate change before automatic renewal.

In some cases, your payment date may change, for example, when your payment method cannot be processed or when you change your subscription plan. To view your next payment date, visit the website and click on the “Subscription” link on the “Account” page.

Cancellation and Refunds

You must cancel your subscription according to the cancellation procedures disclosed to you at purchase and in the Subscription Terms.

Please refer to the Subscription Terms to see if you are eligible for a refund.

Finwinhub may also initiate cancellation of your subscription and provide a refund at its discretion and in accordance with the Subscription Terms.

  1. Data Protection

We collect, store, and process your data according to our Privacy Policy. By using the Service, you agree to the collection, storage, and processing of data in the manner and for the purposes described in the Privacy Policy.

  1. Use of Information and Intellectual Property

All information, text, images, graphics, marks, logos, compilations (i.e., the collection, arrangement, or assembly of information), data, other content, software, and materials available through or at our Website are the property of us or third parties.

You are granted a non-exclusive license to use our Service for personal, non-commercial purposes. No other rights or uses of the Service are granted to you unless explicitly stated in these Terms. Please do not infringe on our intellectual property rights.

The information you provide us when registering for Finwinhub, your “User Content,” belongs to you, and we do not own any rights to it. However, you agree that we may retain a copy of all registration information and User Content and use all such information as necessary or relevant to the operation of the Service and as described in these Terms.

If you believe your intellectual property rights have been infringed, please contact us through the Support Center. We may request additional information and remove or disable content deemed to be infringing, and we may also terminate the accounts of repeat infringers.

  1. Third-Party Advertising

Our Service may contain links to third-party websites and advertisements for third-party products or services. We are not responsible for these third-party advertisements, and you use them at your own risk. When you link to a third-party website, the terms and conditions of that website will apply to your relationship with the owner of that website. Be careful and conduct your own investigations about any such advertisements.

You hereby release us, our officers, employees, agents, and successors from any demands, claims, and any losses, damages, and actions, directly or indirectly related to such third-party advertisements, products, and services.

  1. Compliance

The Service is provided under the laws of the Republic of Cyprus. We do not guarantee or represent that the Service or Digital Content is applicable or available for use in other locations.

If you use the Service from a jurisdiction other than the Republic of Cyprus, you do so at your own risk, and you are responsible for compliance with any and all local laws applicable to your use of the Service.

  1. Copyright Statement

Finwinhub has registered copyrights for its products, including but not limited to all materials, logos, etc.

Any redistribution or reproduction of part or all of the Service and/or Digital Content available through subscription services in any form is prohibited. Any other use of the Service and/or Digital Content must be licensed in writing by Finwinhub.

  1. User Representations and Limitations

Representations and Warranties

By using the Service, you represent and warrant that:

  • you have the legal capacity and you agree to abide by these Terms;
  • you are not under 16 years old;
  • you will not access the Service through any automated or non-human means, including but not limited to, any robot, cheat tool, scanner, or offline reader accessing the Service, or use or launch any unauthorized script or other software;
  • you will not use the Service for any illegal or unauthorized purpose;
  • you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country;
  • you are not listed on any U.S. government list of prohibited or restricted parties; and
  • your use of the Service will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your current or future use of the Service (or any portion thereof).

You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Service, you agree not to:

Regarding Information on the Service. Any statement or information that may be posted on the Service is intended for informational and educational purposes only and is not intended to replace or substitute for any professional financial, legal, or other advice.

Regarding Any Advice. Finwinhub does not provide investment or financial advice or endorse the purchase or sale of any securities or investments through the Service.

Regarding Expectations. There is no guarantee that the Digital Content will meet your needs or requirements or those of any other person. The Service may not be suitable for everyone and is not a substitute for professional financial advice.

Regarding Results. We do not make any guarantees about the level of success you may achieve, and you accept the risk that results will differ among individuals. The Service may provide examples of exceptional results that do not apply to the average person and are not intended to represent or guarantee that anyone will achieve the same or similar results.

Regarding Capital Risk. Finwinhub is an educational platform, you cannot invest with us. You should acknowledge that if you decide to invest independently, there is a risk of capital loss and income is not guaranteed and will depend on many factors. Your investment decisions should be made under your own careful consideration and entirely at your will.

Regarding Representations. Finwinhub makes no representations or warranties and, to the fullest extent allowed by law, explicitly disclaims any and all liability related to your reliance on statements or other information provided in or through the Service. If you have specific concerns or a situation arises where you require professional advice, you should consult with an appropriately trained and qualified specialist.

Regarding Other Products Used. The inclusion of any other website or product information in the Service does not imply a recommendation but only offers possible options. It is your responsibility to conduct appropriate investigations and due diligence about the information specified before making any decisions.

Regarding Information. Finwinhub will not be liable to the User for any indirect, consequential, special, incidental, punitive, or exemplary damages arising from or related to access or use of the website’s services or digital content, tools, or prizes, or related to any errors, transmission, computer virus, or line or system error, including but not limited to, lost profits, lost savings, and lost revenues.

  1. Limitation of Legal Liability

ACCESS TO, AND USE OF, THE SERVICE (INCLUDING DIGITAL CONTENT AND USER CONTENT), AND THIRD-PARTY ADVERTISEMENTS ARE AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM SUCH ACTIVITIES.

REGARDLESS OF ANYTHING TO THE CONTRARY CONTAINED HEREIN, YOU AGREE THAT THE TOTAL LEGAL LIABILITY OF FINWINHUB TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE APPLICATION, CONTENT, SERVICES, OR PRODUCTS IS LIMITED TO THE AMOUNTS YOU HAVE PAID TO FINWINHUB TO ACCESS AND USE THE SERVICE. THE DAMAGE LIMITATIONS STATED ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN FINWINHUB AND YOU.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY DEPENDING ON THE JURISDICTION.

  1. Indemnification

In all cases, Finwinhub shall not be liable for any loss, damage, or injury, including but not limited to, any indirect, consequential, special, incidental, or punitive damages arising from, or related to the use of the Service, including but not limited to, any decisions made or actions taken based on information contained in the Service, or any errors or omissions in the Service.

By using the Service, you agree to indemnify, defend, and hold harmless Finwinhub from and against any and all claims, complaints, lawsuits, or other liabilities, including reasonable attorney’s fees, arising from your use of the Service or your decision to follow any advice, recommendations, or instructions provided therein.

You agree to indemnify and hold harmless Finwinhub, its subsidiaries, partners, and related companies, suppliers, licensors, and partners, and the officers, directors, employees, agents, and representatives of each of them, including costs and attorney’s fees, from any claim or demand made by any third party arising from (i) your use of the Service or Digital Content Products, (ii) your User Content, or (ii) your violation of these Terms.

  1. Dispute Resolution

If a dispute arises, we will make every effort to resolve it through negotiation. Please send any complaints and requests directly to the Support Service through the Support Center. We will make every effort to resolve your issue. If we cannot reach an agreement, disputes will be governed by the laws of the Republic of Vietnam and resolved through mediation at the Hanoi Court, Vietnam.

  1. Other Terms

We may occasionally update our Service and may change information without notice. Please note that some situations beyond our control may cause delays in the provision of our Service. We may at any time modify or discontinue, temporarily or permanently, the Service (or any part thereof) at our sole discretion without prior notice. You agree that we will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service (to the extent permitted by law).

  1. Changes

We may occasionally change these Terms. This usually happens when the law or a part of our business changes. We may notify you of significant changes, but we are not obligated to do so. If you continue to use our Service after any changes, it means you have accepted those changes. If you receive a notice from us about any such changes, you will have 14 (fourteen) days to object or opt-out of using the Service, if you do not object or opt-out, it means you have accepted the changes to the Terms.
